Being beaten for no reason, arrested on false charges and cuffed wasn't enough. The ABC cops also shackled this honor student's feet.
This has to end. It has to. It just has to

Maybe, just maybe, this time, the cops don't have a prayer of escaping justice. But we thought that with Eric Garner, John Crawford, the innocent child, Tamir Rice and so many others.
At what point will the federal government step in and end the insanity?

Among other merit scholarships he won and leadership posts he held, he is the only African-American to be currently elected to UVa's Honor Board. That Board oversees UVa's 150 year old Honor System.

This is why I think that schools are failing. Not because of math scores, but because basic civics and cultural history are not taught.
They can't be easily quantified on standardized tests.
As a result we all get stuck with a bunch of ignorant tone deaf racists and bigots who in turn elect a bunch of ignorant tone deaf racists and bigots who then systematically destroy whatever fragile progress we have made toward racial and sexual equality over the last 50 years....

(999 posts)Here is a scary thought. The charge of public intoxication does not have a sobriety test attached to it. The charge is solely at the discretion of the officer and what he or she determines to be public. Same goes for disorderly conduct it is simply up to the officer to determine what they will or will not accept. I am surprised that a BAC was actually preformed. Probably because of the injury he suffered and they wanted to ensure that he was in fact intoxicated which turned out not to be the case. Also being released on bail for such a minor offense is truly odd.
On a different note each year I go to an annual brew festival that is held outside of Leesburg Virginia in June. At the last one there was this motor coach/tour bus that was decked out in the colors of the Commonwealth of Virginia. It turns out that the Alcohol Control Board in Virginia has a rather large budget and so they bought nice toys that they take to events like this and then arrest people if they appear to be intoxicated. Gotta make money somehow since we have cut the tax base.
Considering the time between him walking away from the bar and his ending up on the ground, the bar owner's statement and the fact he wasn't legally intoxicated, I think the ABC cops will have a tough time with their charges sticking.
But you raise a valid point
JPZenger

(10,045 posts)for the Virginia ABC to even HAVE cops! None. This is the same bunch that terrorized Elizabeth Daly, a WHITE FEMALE student at UVA, last summer. Elizabeth sued the ABC for $40M. They settled out of court for $212K, which will probably pay the rest of her tuition at UVA. I think I see another lawsuit coming their way.... Gov. McAuliffe really needs to disband this outfit. They are nothing but a bunch of little SS wannabes. They treat the JMU students up here in Harrisonburg with the same contempt.

(78,249 posts)In an earlier thread on this atrocity, someone pointed out that there are no standalone bars in Charlottesville. The place is also a restaurant; Martese may well have gone there to eat.

(17,997 posts)The restaurant was closed and it was strictly operating as a bar. And being St Patricks day, they were being extra careful
JPZenger
(6,819 posts)Normally, the businesses that sell alcohol allow persons under 21 to enter but not drink. On St. Patrick's Day night, this business decided to limit entry to persons over 21, so they could sell more alcohol. Martese may not have realized that, until he had a cordial conversation with the co-owner, who was originally from his same hometown of Chicago.
In any case, Martese had showed a valid ID showing he was 20 years old. Then the 3 alcohol agents took him down and bashed his head into the sidewalk.
The alcohol agents had warned the co-owner in advance that they would be watching his business closely because it had the word "Irish" in its name and because they needed to prevent "a riot." Because the ABC agents had warned him that they were going to be watching his business closely, the co-owner decided to personally work the door.
This restaurant is immediately across the street from the large UVa Medical Center and the part of UVa that was designed by Mr. Jefferson, in the middle of a row of pleasant student-oriented businesses.

It is an interesting thought. No doubt that the crowd could have stopped it. But it would not take long for many more cops to show up and even less time for one of them to pull out their weapon and use it on a few people.
In a case like this, where it is so obvious that the cops are in the wrong, I wonder what would have happened in court. I know what should happen, but I believe that each person defending Johnson would end up doing time.
