Freedom Industries President facing federal fraud charges

Charleston, WV - Gary Southern, President of Freedom Industries during the January 2014 MCHM spill into the Elk River, is facing charges of bankruptcy fraud, lying under oath and wire fraud.

According to the criminal complaint filed in federal court in Charleston, Southern lied under oath about his role at Freedom Industries prior to the spill in order to deflect blame from himself and protect himself financially.

FBI Special Agent James Lafferty II says in the criminal complaint that Southern engaged "in a pattern of deceitful behavior, which included numerous false and/or fraudulent statements about his role at Freedom, his role in the sale of Freedom to Chemstream, and his knowledge about conditions at the Etowah Facility.”

In bankruptcy court, Southern said under oath that his role with Freedom Industries prior to its sale to Chemstream, a Pennsylvania company that bought Freedom on December 6, 2013, was as a "part-time financial-type consultant," and that his role in Freedom Industries sale to Chemstream was "superficial."

UPDATE.. "Four Executives Indicted From Company Behind West Virginia Chemical Spill"

The U.S. Attorney General’s office has filed an indictment against four executives of the company that contaminated drinking water for 300,000 West Virginians this past January, alleging violations of the Clean Water Act.

The indictment marks the second time this month that former Freedom Industries CEO Gary Southern has been charged with violations related to a massive chemical spill that saw 10,000 gallons of a coal-cleaning chemical called crude MCHM dumped into West Virginia’s Elk River. Also named in Wednesdsay’s indictment are company ex-president Dennis Farrell, former secretary William Tis, and onetime vice president Charles Herzing.

This slimeball stuck in my mind. Just passed by CNN again and they're discussing the weather - in the likely vicinity of that missing plane. I'd like nothing better than if they found it safe and sound, but there is literally no information. After the break, they're going to do a comparison to the previous missing plane...

and it will likely take many decades for it to disappear from the creek and groundwater, decades of needing to wait for the water truck so you can cook some dinner.

Justice will be served if they don't just throw those bastards into prison but only if they take all their wealth and use it to make sure everybody in the area and downstream has safe drinking water for as long as it takes for that shit to clear out of it.

They didn't give a shit who they poisoned, they didn't give a shit if they killed the kids. They need to be deprived of the only thing they ever did give a shit about, money.

Wives will get Social Security and the proceeds from the family home. Children will have to get jobs. Welcome to our world.

I am sure some right wing judge will throw out the verdict, and they won't spend one second in jail.

Look at the Exxon Valdez case. What did Exxon pay? $20. I think it wa 1/20th of the verdict. Right wing corporate owned judges do a lot for the corporations that elect them now don't they?

Justice is what money can buy. The more money you have the more justice you will get.

So you think the West Virginia Neanderthals inspected all the other chemical storage sites to see how many of them were storing deadly chemicals in leaky rusty shitholes? You know, so they can avoid this happening again?

Kinda reminds me of the fertilizer plant the blew up, and killed half the town, and the owners pretty much lied about every single thing to the once ever 50 year inspectors.

(Bribe) of his buddies, the attorneys he appointed to the Plaintiff's Steering Committee (PSC) to represent the victims of the BP oil spill. BP has offered $660,000,000 to the PSC for agreeing to the terrible Class Action Settlement where currently 75% of the victims are being denied and the other 25% being paid a pittance of their losses. The kicker is that the PSC doesn't get the money unless the settlement makes it through without being overturned. The Judge would not let us speak at the un-"Fairness Hearing" to explain our objections to this virtually one-sided agreement. All of the points we made in the brief that we filed for the hearing have come sadly true, yet the PSC will not try to overturn the very bad deal because they lose the $660,000,000!
To make matters worse, BP had inserted a sealed provision that said that they reserved the right to back out of the deal if a certain percentage of claimants opted out of it. The Judge sent letters to our clients who opted out advising them they could opt back in if they filled out the enclosed form and sent it back to the court. The Judge never sent us the letter or notified us he was contacting our clients and advising them to do something we advised against.
This is only the tip of the iceberg in the most corrupt case of all time!

forcing them to drink the water they poisoned. These assholes perpetrate this shit because they can. Because they're rarely ever held responsible. Because they aren't forced to hurt in some way. Like ALL their money taken from them and distributed to their victims. Like the wrongs they committed against others are directly and individually visited back upon THEM. Like NONE of the fines and financial penalties are deductible. Not a nickel's worth! Like NONE of the costs and troubles are escapade. They get to swallow it ALL. And wear it around for a LONG time.

Maybe there would be some deterrent. SOME deterrent that would put some future fiends off trying something like that themselves.
