Good vibes for tomorrow's Supreme Court rulings.

With the fuck up today, maybe we should take a minute to send good vibes for the rulings on Marriage Equality tomorrow!

I stand with all my brothers and sisters hoping the SCJ's make the right choice.

Opus Dei Catholics will never overthrow DOMA at the national level. Same sex married couples will have to file their taxes separately.

I don't expect anything out of this court except exalting corporations and oppressing human beings.

I mostly just wanted everyone to be aware the two issues (I think both) are coming up tomorrow.

It may be 6-3.

I think both Kennedy and Roberts vote against DOMA. And Roberts writes the opinion because he wants this one.

I could be wrong, but it could be something like that.

I just cannot see how DOMA passes any Constitutional muster.

Dare one hope for an 8-1? Or a 9-0? But those are probably delusional wishes. No way does Fat Tony or Thomas rule against DOMA. The best we can hope for is 7-2, a very long shot, IMHO.

Similar to his Romer decision. I could see Roberts joining.

You know Scalia couldn't support gay marriage, he loathes the homosexuals. And Thomas never strays from Scalia. Not sure on Alito. He is so state's rights, he may strike it down with the majority or in a concurrence that feds should be out of defining marriage, it is for the states.

But, you are right. There is no way this passes any test. Not even a rational basis, because there is no legitimate state interest to can be articulated. The oral arguments made that abundantly clear.

That won't stop Fat Tony, Thomas, and possibly Alito from making some idiotic argument to support DOMA.

My question is this.

How in the fuck do you defend marriage is only between a man and a woman without invoking religion, even if it's in an obtuse reference? I have never heard any argument denying equal marriage rights that didn't invoke some religious argument. Not once!

"natural family" - thats how they are trying to frame it anyway. The only problem with this argument is one is not required to have kids if one is legally married, and it's never been a requirement. Add to that every credible study, going back over 20 years, shows children do best with two parents regardless of the sex of those parents.

Its all grasping at straws at this point.

My prediction:

DOMA Section 3 overturned with a split rational from the judges (no scrutiny will be set for gay rights, for now).

Prop8 - we be rejected on the fact that the propionates have no legal standing (and I agree, as much as I would love to see the case ruled on that would set a dangerous future where standing could be anyone who disagrees with the law, with no damages needed).

Are adoptive parents a natural family with their children?

How about a couple where the wife has a hysterectomy due to early cancer?

So natural family falls by the wayside from the beginning. Just as we no longer restrict the rights of bastards, so shall society not restrict the rights of the LGBT populace no matter their significance in the populace.
