The most remarkable thing about the Supreme Courts opinions announced Monday was not what the justices wrote or said. It was what Samuel Alito did.
The associate justice, a George W. Bush appointee, read two opinions, both 5-4 decisions that split the court along its usual right-left divide. But Alito didnt stop there. When Justice Ruth Bader Ginsburg read her dissent from the bench, Alito visibly mocked his colleague.
Ginsburg, the second woman to serve on the high court, was making her argument about how the majority opinion made it easier for sexual harassment to occur in the workplace when Alito, seated immediately to Ginsburgs left, shook his head from side to side in disagreement, rolled his eyes and looked at the ceiling.
His treatment of the 80-year-old Ginsburg, 17 years his elder and with 13 years more seniority, was a curious display of judicial temperament or, more accurately, judicial intemperance. Typically, justices state their differences in words and Alito, as it happens, had just spoken several hundred of his own from the bench. But he frequently supplements words with middle-school gestures.

(45,251 posts)First, Obama had just attacked a decision of the Supreme Court during the SOTU.
Ginsburg had not attacked Alito.
Second, Alito shook his head no. Maybe he even mouthed the word "no.".
That was not the tradition at the SOTU, but it was disagreement with Obama's interpretation of Citizens United, not mocking Obama. Mocking is far more disrespectful than disagreement on issues.
And Obama was not an 80 year old fellow Justice, in an institution that prides itself on collegiality.
Tradition entitles the President to speak at the SOTU without back talk from Congress or the Justices and he is entitled to respect, too, but I think what Alito did to Ginsburg was worse than what he did to Obama.

(4,015 posts)... is and has always been the most dysfunctional part of the US, ever since this country was founded. It has almost never lived up to what it should be - an impartial body of review, instead being just another stage for political kabuki.
This court was instrumental in the dismantling of America, yet it never really caught flak for it. It is mostly still treated with an amount of respect it simply never deserved.

Rehnquist was not liberal, but, as I said, his court was very pro-first amendment.
Most scholars would say that the most liberal Justice ever, even more thank Ginsburg, was Stevens, also a Republican appointee.
I agree that the court splits 5-4 too often these days along political lines, but I don't know if that was always the case.

But, I would not take a thing away from Douglas, at least before he allegedly became senile.

(10,597 posts)... this Court has gone. Alito nor Thomas should ever have been confirmed. Maybe had there been respectable judges in those spots, perhaps the rest of the repubs on the court might not have leaned so far to the right.
That is absolutely disgusting behavior, mocking Ginsburg. He could bring a crossword puzzle book or a newspaper to read when he gets bored. So childish. It's just disrespectful of not only Justice Ginsberg, but everyone in the room who seen him do it. I hope Republicans are proud of him.

The U.S. Chamber of Commerce has been getting right wing Judges elected and grooming them to rise to the Courts of Appeals (mission accomplished on that score) and has made the Judiciary hyper partisan where they should not be partisan at all! Most Americans have no idea how much they have lost of their rights (come to Texas to find out what life under Republican rule is like)! It was not an accident that he reacted at the State of the Union address when President Obama criticized Citizens United! He is a petty piece of shit with power for life!

Whether he agrees or disagrees with Justice Ginsburg, he should still show her the proper respect. It makes him look like an uneducated jackass when he acts like this. I wonder if his own mother would approve of his treatment of Justice Ginsburg today?
