Alito is a dick to Justice Ginsburg

By Dana Milbank, Monday, June 24, 5:07 PM

The most remarkable thing about the Supreme Court’s opinions announced Monday was not what the justices wrote or said. It was what Samuel Alito did.

The associate justice, a George W. Bush appointee, read two opinions, both 5-4 decisions that split the court along its usual right-left divide. But Alito didn’t stop there. When Justice Ruth Bader Ginsburg read her dissent from the bench, Alito visibly mocked his colleague.

Ginsburg, the second woman to serve on the high court, was making her argument about how the majority opinion made it easier for sexual harassment to occur in the workplace when Alito, seated immediately to Ginsburg’s left, shook his head from side to side in disagreement, rolled his eyes and looked at the ceiling.

His treatment of the 80-year-old Ginsburg, 17 years his elder and with 13 years more seniority, was a curious display of judicial temperament or, more accurately, judicial intemperance. Typically, justices state their differences in words — and Alito, as it happens, had just spoken several hundred of his own from the bench. But he frequently supplements words with middle-school gestures.

First, Obama had just attacked a decision of the Supreme Court during the SOTU.

Ginsburg had not attacked Alito.

Second, Alito shook his head no. Maybe he even mouthed the word "no.".

That was not the tradition at the SOTU, but it was disagreement with Obama's interpretation of Citizens United, not mocking Obama. Mocking is far more disrespectful than disagreement on issues.

And Obama was not an 80 year old fellow Justice, in an institution that prides itself on collegiality.

Tradition entitles the President to speak at the SOTU without back talk from Congress or the Justices and he is entitled to respect, too, but I think what Alito did to Ginsburg was worse than what he did to Obama.

Too bad Bush didn't get his first choice for replacing Sandra Day O'Connor, before he was forced to pick Alito:

intellectual heavyweight Harriet Myers, with gravitas up the wazoo,
no bad habits picked up from having been a lesser Judge, ever -
and with an absolutely clean slate on all the important issues of the day,
keeping herself unburdened of any preconceived ideas about cases that might come before the Supreme Court.

Harriet Myers - impartial, serious, free from any feelings of obligation or inferiority to the Executive Branch of the Government that wanted to nominate her.

She would have been the type of Conservative Associate Justice of the Supreme Court that we've all come to expect in the 21st century:

Most scholars would say that the most liberal Justice ever, even more thank Ginsburg, was Stevens, also a Republican appointee.

REASON FOR ALERT:

This post is disruptive, hurtful, rude, insensitive, over-the-top, or otherwise inappropriate. (See Community Standards.)

YOUR COMMENTS:

Trashy post, should be hidden DU is better than this middle school crap.

JURY RESULTS

A randomly-selected Jury of DU members completed their review of this alert at Tue Jun 25, 2013, 08:09 PM, and voted 2-4 to LEAVE IT ALONE.

Juror #1 voted to LEAVE IT ALONE and said: No explanation given
Juror #2 voted to LEAVE IT ALONE and said: No explanation given
Juror #3 voted to HIDE IT and said: OK. 1. I generally vote to leave about 99% of the time. 2. I hate me some Alito in a major way.

That being said--we don't need to give any traction to the RW with death wishes for SCOTUS justices.
Juror #4 voted to HIDE IT and said: Alito and Thomas are evil. But openly wishing death on them is unacceptable, just sophomoric as Alito is (which DU doesn't need to be seen as), and could even cause legal issues (in the extreme).
Juror #5 voted to LEAVE IT ALONE and said: No explanation given

Juror #6 voted to LEAVE IT ALONE and said: My sentiments exactly. Alerter probably worships the ground those two walk on and is paid to come here and disrupt.
Special note to Juror #6... you must be a real piece of work to wish physical harm upon others... and actually I paid to be here and not disrupt, but thanks for making our community such a great place.

Thank you.
