Bush withdraws Miers nomination
The White House released a letter from Miers to Bush on Thursday requesting that her name be withdrawn, citing a dispute with the Senate over documents related to her White House service. Bush said he would reluctantly accept her choice.
WASHINGTON (MarketWatch) -- Responding to an increasingly bitter political fight in his own party, President Bush on Thursday withdrew Harriet Miers from consideration as Supreme Court justice, the first such action by any president in almost 40 years.
The withdrawal of the nomination of Miers to replace Sandra Day O'Connor on the nation's highest court follows a steady drumbeat of criticism of Miers from conservatives and lukewarm support for her from Senate Republicans.
The pressure is now on Bush from his conservative base to nominate someone with a strong judicial record. Miers had never been a judge, instead serving most of her career as a corporate lawyer.
Her record of defending companies like Microsoft MSFT +1.60% and SunGard Data Systems Inc. SDS -1.76% won her support from business stalwarts like the U.S. Chamber of Commerce. But Bush's next nominee will almost certainly have to demonstrate a record on key social issues like abortion and affirmative action.
"I have been informed repeatedly that in lieu of records, I would be expected to testify about my service in the White House to demonstrate my experience and judicial philosophy," Miers wrote.
"While I believe that my lengthy career provides sufficient evidence for consideration of my nomination, I am convinced the efforts to obtain Executive Branch materials and information will continue," she wrote.

(84,711 posts)asked her the hard ball questions that the investigative reports had turned up. HuffPost had an article about Senator John Thune not even following up on the Suprime Banking problem. Would have thought even Democrats would have been more thorough given that she is such a liability to Obama and the Party.
Why did no one bother to follow through with tougher questioning when so many thought they would in the Senate Committee.
That's what worries me. What if there's more that comes out about her and the Repugs are just waiting there to go after her once she's there in Commerce? Why would Dems take the chance of that. Obama owes her...so there is that...but, with tough questioning he could have pressured her to withdraw and they could have made up some excuse that would have "saved face." If Obama was pressured into nominating her...surely someone on that committee could have helped him out of the pressure by doing some real grilling of her on the ample information revealed in all her past dealings which are not reflective of what most of our Democrats would feel are good reflection on our Party. Her record on Labor at Hyatt alone should have caused much more backlash from Dems on Committee.
