General Discussion
Related: Editorials & Other Articles, Issue Forums, Alliance Forums, Region ForumsWhat must the Supreme Court be thinking?
How many of them are simple, right-wing Republicans and how many of them are MAGA-Republicans?
Are they really that different from the general population of Republicans?
After all, we saw where they went with the Dobbs decision on Roe v Wade.
Do they care enough for our Constitution to go against the wishes of their Party?
I, personally, do not have a lot of faith in this Supreme Court. I think they are a very partisan group of crooked justices, but that is just me. Perhaps they will disappoint and follow the Constitution?
I tend to think they are looking for some loopholes to delay some very difficult decisions. They do not want to say that Trump does not have absolute immunity. They do not want to say that we are all equal in the eyes of the law. They do not want to rule that states can remove candidates off their ballots per the Constitution. The Constitution is not that clear to them, in my opinion.
They all wanted the job. I do not relish the decisions they will need to make to preserve our democracy and our Constitution. They must understand these are unprecedented times. There are no other cases for them to fall back on. There is only the Constitution and their oath to defend it.

(43,619 posts)What we have, and have had with various justices through our history, is Justices obsessed with power, monied interests, status quo. They enjoy the unpredictability, it augments their power.
What will we get? They don't like setting precedent with broad rulings. They rule on small points and call it genius. Obamacare was really a tax. That's how it passed muster. Not that it was good for people, or addressed income inequality. It was Congress' privilege to tax. They're big on privileges.
So I suspect Trump will be flagged off the ballot, 5-4, on some minor technicality, like he wasn't doing the people's business because he led the insurrection flame from outside the White House and had too many henchmen to actually be in control of his presidential duties.

(116,122 posts)Six of them are conservative ideologues but as far as I can tell none are devoted Trumpers. Their conservative ideology tends to further business interests and religious "freedom," but not TFG personally - sometimes their decisions aligned with the positions of his administration but not always. A conservative majority would have overruled Dobbs , for example, no matter who was president - they didn't do it for him. The question will be whether a conservative SCOTUS majority thinks affirming the Colorado case (or any of the other 14th amendment cases that come before them) benefits the oligarchy or other conservative causes, not whether it keeps TFG on the ballot, or any ballots (with no guarantee he will be elected). The billionaires and financial markets hate uncertainty even more than they like TFG. I really don't know how this will come out, but it seems to me that SCOTUS' decision is likely to be one that the markets like, not necessarily one that that TFG likes.

(54,024 posts)where they stand. The so-called 6 originalists have a problem though. They're supposed to be strict constructionists who go by what the Constitution says, so that would mean they should go by what the 14th Amendment, Sec. 3 says...that no one who participated in an insurrection against the government is eligible to hold any government or miliatary office.
And it's plain as day that trump exhorted the J6 rally crowd to march to the Capitol and "fight or you won't have a country to fight for."
He also promised he would be there with them. The Secret Service stopped him for his own protection, but he watched the attack on the Capitol Building on TV and wouldn't move to stop it for 3+ hours despite the urging by family and staff to stop it and send in the Nat'l Guard.
That's a distinct dereliction of duty by the President of the United States, making him even further ineligible to hold office again.
Let's see if the 6 magats on the court will weasel their way out of ruling on it by sending it to the Circuit Court.

(16,166 posts)until they find out if he's going to be the R nominee, if he is, they'll say he's 100% immune, but that it only applies to him as they did in Bush v. Gore (no matter how many times it has actually been used as precedent since).

(11,554 posts)They have more power it seems than any other office since its for life and no matter what they do (thinking about Thomas) nothing is done to them.
So now that they are there why would they care what Trump thinks unless they personally believe same way? They have more power than he does especially with him on the outside.
I think Brett Kavenaugh has been trying a bit to fix his past and will do whatever it takes. Amy was thrown in quickly few weeks before we voted after republicans refused to let Obama do so with 9 months. She also seems besides abortion to be open to changing sides.

(10,005 posts)... they revealed themselves in Bush v Gore. Since then, they have added more right-wing justices. I think there is a leaning toward God (Jesus) being governor of the US constitution ("Our Creator..." . I know Thomas thinks he needs more money, but they are all paid well and should be working overtime to QUICKLY release opinions on the cases involving Crooked Donald.
