(32,739 posts)I know I read that some where.
The Treaty Clause is part of Article II, Section 2, Clause 2 of the United States Constitution that empowers the President of the United States to propose and chiefly negotiate agreements between the United States and other countries, which, upon receiving the advice and consent of a two-thirds supermajority vote of the United States Senate, become binding with the force of federal law. https://en.wikipedia.org/wiki/Treaty_Clause

(58,758 posts)That does, however apply to those treaties with foreign nations approved by the Senate. Not sure if tribal treaties have that same force. White folks have routinely ignored them for going on 200 years, though, so the track record is not good.

(53,061 posts)Used "reservation" but Congress would have to pass an actual law to do so.
Decision not only "takes" land from OK but also 4 other tribes.
Congress will pass the necessary legislation, land borders will be reinstated, but Gorsuch's point is that these situations only happen because guys like Cruz aren't doing their job
If you missed the details of the case the point of the case it was to overturn the convictions of a serial rapist who was so egregious that he got more than 1000 years sentence. The appeal was not based on that he didn't do it but jurisdictionally it was the wrong court. Will be retried by a Federal Court.

(2,012 posts)of the Betrayal of the Five Civilized Tribes. I knew Angie Debo in Oklahoma when she wrote "And Still the Waters Run" in 1940, the story of the independent Indian republics of the Choctaws, Chickasaws, Cherokees, Creeks and Seminoles. In spite of solemn treaties that were to endure "as long as the waters run" the Indians saw their patrimony dissipated, their tribal identity submerged in the general citizenship, and their ancient culture destroyed. How marvelous that the Supreme Court, though it took them a while, finally ruled that half of Oklahoma is Native American land. Wonder where all those Tulsans will go; I hope it's not Colorado.
