(13,059 posts)He will not automatically rule to overturn the three judge panel because he is mad the Republicans for keeping him off from the SCOTUS. So I am not sure what you are implying.

(13,059 posts)not take up the case. They can take it up or they can decide to let the decision of the three judge panel stand without taking it up. Historically, full circuits are reluctant to overturn the decisions of three judge panels. There has to be a pretty darn good reason first.
There are three possible scenarios. They can refuse to take it up, they can take it up and uphold the three judge panel, or they can take it up and overturn the panel. So we shall see.
Edit - There is also another possibility. The full circuit could decide to not act on it but send it back to the three judge panel for further consideration .
