Courts and commentators have tended to discuss each of these three areas of commerce as a separate power granted to Congress. It is common to see the individual components of the Commerce Clause referred to under specific terms: the Foreign Commerce Clause, the Interstate Commerce Clause, and the Indian Commerce Clause."



This singular issue is the reason for the Constitutional Convention of 1789.



"The Commerce Clause emerged as the Framers' response to the central problem giving rise to the Constitution itself: the absence of any federal commerce power under the Articles of Confederation. For the first century of our history, the primary use of the Clause was to preclude the kind of discriminatory state legislation that had once been permissible. Then, in response to rapid industrial development and an increasingly interdependent national economy, Congress 'ushered in a new era of federal regulation under the commerce power,' beginning with the enactment of the Interstate Commerce Act in 1887 and the Sherman Antitrust Act in 1890."



So, setting up checkpoints between the States is highly un-Constitutional and if it's done it should be up to the US Congress and not at the discretion of the individual States.

So, unless the Constitution is suspended. Which I suppose Trump could attempt since he doesn't pay any attention to it, anyway. Or, if the US Congress deems it necessary, it better not be happening.

Apparently, the State of Florida did. To the extent that they have erected a barrier to commerce between the states, one might be able to successfully sue them for it in the Supreme Court, but, otherwise, I doubt that there’s much that anybody can do about it.

NYC who has the most of all doesn’t want it. I think it’s not a good idea to not close border temporarily. Of course this is the city where a city council person said go out and enjoy yourself in the middle of the pandemic. Ugh.

Since I had my second ever hidden post this past week stating the fact that the huge majority of cases down here are from snowbirds and tourists.

DeSantis sucks, and it's not a coincidence that the only counties he shut down are those that voted against him, but I also have no problem with the checkpoints here and at the SOFL airports.

Get off I10 at Mobile, go north on I65 until well over the state line. Exit and take a FTM road south. Re-enter I10 at Pensacola.

In trucking, back in the day, sometimes we would "run around" a scalehouse at the port of entry by doing what you described. Back in the day, you could go from CA to NY without ever being weighed in the way you described.

I understand passions are running high and I have no intention of mixing it up with you. But if you had, for instance, said something similar about New York, the Western U.S. or any other city, state or region it would have been inappropriate and hurtful to the people who live there. Southern bashing has become sport on DU this week, but for those of us living here the horrible decisions being made by politicians is a life and death matter. We've been abandoned by our leaders and it hurts even more to be attacked by fellow Democrats as if we are at fault.

So if you want to attack a particular politician down here, fire away. They deserve it. I am just respectfully requesting you choose your words carefully so you do not include the majority of people living here when you do so. Not all Southerners are evangelical Republicans.

They are taking contact information and knocking on doors randomly to do spot checks to make sure the people are following the rules.

I am one of those people singing her praises. Gina Raimondo has done a great job as Governor and is doing a great job during this pandemic.

The new rule is that anyone traveling from out of state for non-work related reasons must quarantine for 14 day when entering the state. It is no longer just New York.

I am currently staying in Mass with my boyfriend for the duration of this. If I were to go home now I would have to quarantine for 14 days. I have ZERO problems with that because I am part of a community that I love and care about.

This is all smoke and mirrors. He has set up "check points" on a couple of the hundreds of highways entering Florida from the North and West. He is not checking on all of the major roads. The only thing he is going to accomplish is pissing off a lot of people from the states he has decided to insult. This old boy tries to emulate and support Trump at every move, including delaying a responsible and effective means of controlling the virus. He is a little smoother than Trump, but just as dumb and evil, and it is obvious that he has visions of a future in the White House.

Florida had a big opportunity to reduce the spread of the virus weeks ago, and DeSantis chose to support the tourist industry rather than the health of the people. Now, he needs to do something, even if it is wrong, to show that he is being tough on the virus. He has been, since the start of the problem, reacting to crisis, two to three weeks late, rather than getting ahead of the problem. It is almost as if he wants to see Florida slammed. Maybe another case of Munchhausen by governor, when it gets really terrible, he can come flying in to be a great hero. Sound familiar?

I live seven miles from Georgia. I need to get out of the house and go for a drive to see how effective his quarantine is.....

My wife and I were somewhat stir crazy, so we went for a Sunday drive. I crossed and recrossed the Fl./Ga. lines in three places about 10 miles apart. I drove about 70 miles, and never saw a cop...period. I guess that DeSantis thinks New Yorkers don't have GPS and can only enter the state on I-95, and New Orleans sufferers can only enter on I-10.

I think we can safely call the DeSantis policy a HOAX, crap, posturing and pure unadulterated male bovine fecal matter.

Feel good press releases to show that he is a leader and is on top of things, and nothing else. Perhaps with strong, positive leadership, we will forget the Spring Break debacle.

I live on an Indian Reservation. The tribal council set up road blocks with tribal police stopping cars
They screen folks for out of state travel. You are only allowed to leave the Agency once a day.
Since I am a non native one cop was suspicious, but most of the tribe knows who I am

There is also a curfew

They are ordering them to quarantine for 14 days if they still decide to come into the state.

Executive Order 20-86, directing all persons who enter the State of Florida from an area with substantial community spread, to include the State of Louisiana, inclusive of those entering the State of Florida by roadways, to isolate or quarantine for a period of 14 days from the time of entry into the State of Florida or the duration of the person’s presence in the State of Florida, whichever is shorter.

Just west of Pensacola.

And it is clear in the footage that trucks are still using the PrePass system (they are passing the station at speed, on the highway) and they are also crossing the static scale on the north side of the scale house.

The lanes shown where the cars are crossing are on the south side of the scale house, the left hand side is the #2 static scale and the other lane is a bypass lane.

So...even though I guess you could say this is a "checkpoint", it doesn't seem too intrusive and it is for the greater public health.

Frankly, I expect to see more of this nationwide.

And FWIW, MOST of the highways entering Florida have at least an agricultural check station, if not a weigh station also, so for those that think this is easy to get around, yeah, it probably is. For now.

Where's the Alabama checkpoint to stop Floridians from entering?
If anyone should be prevented from interstate travel it is us Floridians who are still relaxing on beaches and contributing to the spread. We have only conducted 41,769 test to date. My county (Broward) has over 1.9 million residents. The state has an estimated 21 million residents. Yet DeSantis wants to issue out his personal stash of hydroxylchloroquine, not lock down the state (some beaches are still opened) and blame NY

First I am not a lawyer but I am a retired Federal Officer of 30 years so I do have a fair understanding of the law. ANY state or local government can not suspend the constitution so these road blocks or vehicle stops without reasonable suspicion that a law has been violated are unconstitutional. It is also for me a frightening reminder that any government can be tyrannical when they act out of fear or bigotry. This is why we need strong sane federal leadership in these times! But we don’t! All states have the virus and it will spread slow or fast it is inevitable we just have to deal with it as it comes. Oh and stay home! That is definitely the best practice and we would not have to have this kind of conversation!
