South Carolina A.G. threatens mayors who issue 'stay at home orders'

South Carolina Attorney General Alan Wilson (R) issued an opinion Friday saying local governments do not have the authority to exercise emergency powers that are delegated to the governor by state lawmakers.

Some cities in the state have enacted “stay at home” orders to try to reduce the spread of the COVID-19 virus. However, the attorney general’s opinion ... concluded that only the Governor was empowered to exercise extraordinary emergency powers.

The opinion concludes by saying, “counties and municipalities should be aware that any unauthorized exercise of such emergency powers could subject these political subdivisions to liability ...”

Governor McMaster (R) of South Carolina has refused to issue a ‘stay at home’ order.

if 160,000,000 are infected as is suspected and the death rate is even just 1 percent, that is 1,600,000...

and, of course, there is the need of medical professionals and hospital rooms to provide that care, that 1% can go a lot higher. You can also include the people with non-covid emergencies who won't get proper treatment because of all of this. This could get really bad. These stupid and insane decisions by Republicans to not encourage social distancing are going to have catastrophic consequences.

He was very angry that his favorite bar/restaurant was forced to close.

What had happened is that the Columbia mayor, Steve Benjamin, issued a citywide order and the Charleston mayor, John Tecklenburg also issued a citywide order. I originally thought it was racial, as Columbia has a black mayor. Charleston as a white one. But this is still idiotic.

Even Governor Kay Ivey R-Alabama who hasn't issued a statewide order hasn't gotten in the way of local cities doing it, such as Tuscaloosa & Birmingham. They have Democratic mayors.

All of our days are running together now.




Thursday, the city of Columbia did its order, the next day, SC state issued an opinion that it was invalid. The city has pushed back and is enforcing its order as of this AM.
