any state prosecutor can go to the courts (SCOTUS?) to get this OLC rule that is protecting the fake prez (any POTUS actually) changed. I didn't know this. Why didn't the Dems do this or suggest it by now?

But they also have to be prepared for all the various special legal challenges due to him being president, so it takes a while.

Whether a state prosecutor can or can't indict a sitting President would be up to the Supreme Court to ultimately decide.
Until a state prosecutor actually has an indictment to bring, nothing will likely happen in that regard.

(54,770 posts)ever convict trump on anything related to the election there will always be a few white wingers to hang a jury. I doubt any prosecutor would bring the case.
