(50,567 posts)My feeling is they should forget about the s.241 charge and pursue s.242 charges against Clarke and the other six officers. Its going to take a hell of a lot more proof than is in this search warrant request to prove conspiracy. OTOH they have a fairly good deprivation of civil rights case against each individually.

(50,567 posts)I LMFAO when I saw the statutes this moron is accused of violating, 18 USC 241 and 18 USC 242. These are the first two statutes anyone fighting sovereign citizens learns, because SCs consider them to be a cash machine: if you get pulled over by the police for driving without a license, registration or insurance, you can (supposedly) slap an 18 USC 241/242 suit on their asses and take their homes, cars and everything they own. Driving a car is a God-given right that can't be regulated or curtailed for any reason, and you can sue the shit out of the cops for violating your civil rights if they try to stop you from traveling freely. (In case you're wondering, that's total bullshit but there are a lot of people who believe it.)
18 USC 241 and 242 are Civil Rights-era laws designed to punish KKK members who join the police so they can harass and/or kill blacks without repercussions. The reason this is so funny to me is that the laws were written to protect innocent black people from white asshole cops, and here they're being used to protect an innocent white man against a black asshole cop.
To make an s.241 charge stick, though, they'll have to charge the other officers that harassed this citizen because s.241 is a conspiracy statute. An s.242 case will be a lot easier to prosecute. The maximum sentence is an undisclosed fine and a year in prison for both statutes.
But knowing the Oompa-Loompa in Chief, he'll probably pardon Clarke before trial.
