No ballistics expert, but the black flash looks a lot more like one that would come from explosive/blue-tipped ammo than from some explosive device on the guy.

The GIs all appear to be armed W/ standard issue M4s the standard round for this weapon is a 5.56 NATO 55 grain FMJ round. Explosive ammunition is forbidden by the laws of land warfare.

Clearly the guy was a threat I could hear the NCOIC in the background ordering some one to shoot. The BG kept advancing toward the check point after repeated orders to back off.

Again, I would have shot the very first time the NCOIC gave the order
